1. Governing Law
These Terms, and any dispute, claim, or controversy arising out of or relating to the Pixizen Platform, the Services, or these Terms, shall be governed by and construed in accordance with the laws of the State of New Mexico, United States of America, without regard to its conflict of law principles.
2. Jurisdiction and Venue
Except as otherwise required by applicable law, any legal action or proceeding arising out of these Terms shall be exclusively brought in the state or federal courts located within the State of New Mexico.
The parties hereby irrevocably submit to the personal jurisdiction and venue of such courts.
3. EU Consumer Exception
If you qualify as a consumer residing within the European Union, nothing in this section shall deprive you of the protection afforded by mandatory consumer protection laws of your country of habitual residence.
- Claims may be brought in the courts of your country of residence where required by EU law.
- Mandatory local consumer protection provisions shall prevail in the event of a conflict.
4. International Use Disclaimer
Users acknowledge that Pixizen is operated from the United States. Access to the Services from jurisdictions where such access is unlawful is strictly prohibited. Users remain solely responsible for local legal compliance.
5. Severability
If any provision of this section is found to be unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, while all remaining provisions remain in full effect.
JURISDICTIONAL NOTE
This Governing Law clause forms an essential part of the agreement between the user and Zenbitx LLC and reflects a fair allocation of jurisdictional expectations.
